Pruning a California Coast Live Oak

Hi,
   We have a California Live Oak growing in our yard.  It is a young tree, probably between 5 and 10 years old I think.  The trunk is about 3" diameter.  It is growing fairly straight except for one large branch which is growing off to the side.  That makes the tree very unbalanced and it is growing into the neighbor's yard which they do not like.
   So the questions are: what time of year is right for pruning an oak?  Is there a time that is particularly harmful to the tree?  And are there issues with pruning larger branches such as this one ?  (It's probably 2.5".)
